European commission punishes Microsoft for failing to offer a browser selection in Windows 7 SP1: A very costly mistake!

Those of you who bought a Windows-based laptop or desktop recently will, hopefully for Microsoft, have been directed to a 'choice of browsers' page on your shiny new computer. This list gives you a choice of internet browsers and you can choose to stick with Internet Explorer or go with alternative options such as Chrome, Firefox, Opera and so on.

Microsoft were ordered to do this by the European Commission who 'suspected abuse of dominant position by Microsoft due to the tying of Internet Explorer to Windows' way back in 2009. But, the guys from Redmond were a little naughty, the commission's most recent report found that:
"Microsoft failed to roll out the browser choice screen with its Windows 7 Service Pack 1 from May 2011 until July 2012. 15 million Windows users in the EU therefore did not see the choice screen during this period. Microsoft has acknowledged that the choice screen was not displayed during that time."
With that confirmation then comes the consequences of not sticking to your legal obligations in Europe, something which Commission Vice President ifor competition policy, Joaquín Almunia, said 'require strict compliance [and] a failure to comply is a very serious infringement that must be sanctioned accordingly.'

The way Europe has chosen to sanction Microsoft is through a financial fine. That fine will be €561 million ($732 million or £484.5million)!

With that huge fine in mind there's a lot of people questioning why Microsoft didn't just offer the choice screen in the first place, well it turns out that there was a 'technical error', an error which Microsoft didn't spot for over a year. In Microsoft's defence though, when the issue was brought to their attention they immediately pushed out a software fix and the 15 million affected users were presented with a choice of browsers, that wasn't until Microsoft had been threatened with a fine of up to 10 percent their global annual turnover, which would have equated to somewhere in the region of $7 billion, so in that regard Microsoft got off quite lightly!

At the moment it seems unlikely that we will see any of these sorts of fines handed out to Apple, Microsoft or Google for their tablet based operating systems because the market is so split, but if one reaches the same sort of market dominance which Microsoft achieved with Windows then it is conceivable that they'd face a similar fate!

You can find the full European Commission report here!

Microsoft details the Windows 8 upgrade path!

According to ZDNet’s 'reputable' sources, users upgrading to the new Windows 8, the entry-level consumer version, from Windows 7 Starter, Windows 7 Home Basic, and Windows 7 Home Premium will be able to transfer all of their current settings, personal files and applications, just as they are at the moment! The same will apply for users who upgrade to Windows 8 Pro from all varieties of Windows 7. The same goes for all Enterprise versions of Windows 7 which will be upgraded!

However, users who upgrade to Windows 8 from Windows Vista without SP1will only be able to retain personal files and but won't be able to transfer Windows settings. If SP1 is installed before the upgrade then personal data and system settings will be maintained. But, users upgrading to Windows 8 from Windows XP with SP3 or higher will only be able to retain personal files.

There's a lot of details to consider if you do choose to upgrade, but it might be worth holding off for a while on Windows 8 until it's been thoroughly reviewed and tested so that all the initial bugs get ironed out!

HTC planning a Tizen powered device for 2012.

Since the departure of Nokia from their ex-partner Intel, their love child, Meego, was expected to be somewhat neglected. But, it wasn't long before Samsung, amongst many others, picked up the buck and started building Tizen.

The news here is that HTC will be releasing a phone at some point in 2012 running the software. This is great news for the platform, especially if the rumours that Asus and Acer will be creating phones running this software too before the end of the year pan out. It's become apparent that the platform has been gaining a lot of support from elsewhere too, with the Tizen Association board members now featuring NTT docomo, Orange, Vodafone, SK Telecom, NEC, Panasonic and Telefonica, amongst others.

It looks like Windows Phone may very well have a serious challenger for Third spot in the mobile world if the companies follow through on their word!

In other news:

  • Apple has once again filed for a ban of the Samsung Galaxy Tab in America, so much for sitting down and talking it out eyyy Apple?

  • HTC has been able to trickle some of their devices out today after they were halted by US customs for infringing on dialer patents. The issues have since been addressed but the hold up is because every device has to be checked to prove it's bee updated, which as you can imagine is quite a slow process.
  • Samsung's S-voice apk has recently been leaked by XDA developers but Samsung and Vlingo have teamed up to stop you using it unless you really are rocking a Galaxy S3, sorry guys.
  • Google Chrome is once again the world's most popular browser and this time it'll probably stick!
